Absent any other information I would agree with Count #1. Given his account of the events, it does seem like his removal from the team was in retaliation for his protected speech. There could be additional information that will of course not come out until this goes to trial, assuming it gets that far, since the school district is not going to comment on this.
They do have the right to open carry in Ohio, with no permit. But their presence seemed to cause a mild panic, as noted by the multiple calls to 9-1-1, and when that happens the officer have a duty to investigate to ensure that everything is alright. Open carry is legal in Ohio, but not every citizen has the right to be in possession of a guy.
Disciplinary action?? Why have they not been arrested for theft?
Hate to say it, but it makes having satellite radio all the more appealing.
How exactly is this controversial? MLB rules indicate that if a ball hits the foul pole it's considered fair, not foul. The ball clearly hit the pole, so it's really pretty clear and not at all contentious.
Looking at the picture, it looks more like he's got his fingers crossed, not flipping him off.
