Update: The family of Cory Barron has filed suit against the Cleveland Indians, Live Nation and Minute Men Staffing. They contend that the door to the chute down which Barron fell to his death during a Jason Aldean concert should have been locked. Previously, all parties involved passed the buck on security issues that night. An inquiry by International Research Group on behalf of the family concluded Barron’s death might have involved foul play.

Via Fox 8, who first reported the suit:

“During the evening decedent, Cory Barrron, entered a room in the upper deck of Progressive Field, which had a 5-story garbage chute which led directly to the basement level of the stadium,” the suit stated. “ The aforementioned room was supposed to be locked to prevent unintended access to the room by patrons attending events at the facility as as a basic security precaution.”

The suit further stated the defendants knew the door had been broken, but had failed to repair or replace it.

The suit also said the defendants created “unsafe and dangerous conditions at the facility,” and also failed to provide proper security at the event.

Update (9/23/2014) : The Lorain County Coroner has ruled the cause of Cory Barron’s death as “undetermined” but noted multiple blunt force impacts from his fall down a garbage chute at Progressive Field. Toxicology results showed alcohol in his system could not be “accurately measured due to the state of the body.” No drugs were found in his system. No evidence of foul play was discovered.

More than five weeks after 22-year-old Cory Barron’s body was found at an Oberlin landfill, the Lorain County Coroner’s Office says the toxicology report has still not come back and doesn’t have a current estimate on when it will arrive. It had previously told the Telegraph-Forum on Aug. 19 the results would be arriving “any day now” on the Fremont man.

Cleveland police are working the investigation into the dead body and are awaiting the autopsy and final toxicology reports from Lorain.

Barron, police had theorized back in July, might have fallen down a garbage chute some five stories. Witnesses had described Barron as heavily intoxicated. All parties involved have previously deflected questions about security at the venue the night of the concert.

  2. It is a shame that this case has virtually disappeared from the media. Something is being covered up big time. the news would like us to believe this young man was so drunk he FELL down a garbage chute. Come on People wake up. That man did NOT climb in there on his own. Theres something they don’t want us to know. I bet we will find out after the Indians season is over tho. wouldn’t wanna affect attendance would we owners of progressive field. this is a shame. shame on everyone withholding info on this case

    First of all, “the news” is not making you to “believe” anything. Clearly you’re just that clueless or dumb. The news is simply reporting what has been stated and/or documented. I suggest you learn to read or take a brush-up on reading comprehension.

    It clearly says that the police summarized he *might* have fallen down the chute. It was also stated that his friends said he was extremely intoxicated.
    Not only do I get a hearty chuckle from your drama-queen antics and your inability to read and comprehend, I also LOL at you’re finding a way to blame this on Progressive Field and/or the Indians.

    You’re really going for Total-Stupid aren’t you, Donna? It’s a shame you don’t see how ridiculously ignorant/clueless you are.

  4. Donna, why can’t the story just be what it is? Some things are just what they appear to be. He was so drunk his own friends and family didn’t want him around them at the show. This was truly an accident, period.

  5. I WORKEd at Progressive Field for four years and I have no clue where the garbage chutes are at! This drunk kid wanders into one? If I even attempted to look. for one I would need a badge and possibly a key card… Smells fishy to me.

My son works at progressive field He says that the doors to those trash chutes are locked all the time. certain workers have access. that man didn’t climb in there and fall. he was thrown in… any person with half a brain can figure that out. It has been reported that he had words with a group of men when he was walking a young lady to her section.

  7. If there was indication of foul play or someone pushing him in there then there would be video or someone would have seen it. The kid was blasted out of his mind, he probably thought he was Going to the bathroom and walked through a door that was acidentally left unlocked .i think it was just an unfortunate drunk accident of his own causing

  8. I get what your saying but given the size of the man and the size of the trash chute opening and were it was located in ratio to how tall he was . It doesn’t seem possible. unless he crawled in there literally. but anyway we will never know the truth so oh well.

  9. It wouldn’t come close to the most stupid thing done under the influence of alcohol. Without evidence of foul play, any theories of deliberate wrongdoing are purely speculation. He is not the first young person to make a reckless decision while intoxicated that results in serious and/or lethal injuries–in this particular instance, to himself. Having lost 4 of my own children, I am highly sympathetic and know all too well the pain his family is feeling. It is impossible to understand how such a thing could happen and we search for some way to make sense of this tragedy. Sometimes there is no way to do that. I sincerely hope that they find peace and healing with time.
