The Ohio House of Representatives today passed one of the nation’s tightest laws regulating abortion after the so-called “heartbeat bill” prevailed by a 56-40, mostly party-line vote. Opponents protested and demonstrated as the proceedings dragged on toward these depressing conclusions.
Senate Bill 23 now returns to the Ohio Senate to vote on the amendments added by the Ohio, none of which do anything to protect women. Among the many failed amendments was one to introduce exceptions for rape or incest. (For more failed amendments, check out this thread.)
Ohio Gov. Mike DeWine has indicated he will sign the bill if it passes.
Supporters of the bill not only expect but are excited by the prospects of a prolonged court battle if the bill is signed by DeWine.
As we’ve noted before, courts have struck down similar heartbeat laws in other states, including North Dakota and Iowa, as recently as January.
“Ultimately, this will work its way up to the United States Supreme Court,” DeWine told conservative radio host Hugh Hewitt last month. “And they’ll make that decision.”
John Kasich last year vetoed the heartbeat bill, saying it likely violated the U.S. Constitution under Roe v. Wade. Instead, Kasich signed a law banning abortions after 20 weeks.

Abortion is not Healthcare or Birth Control, so this is amazing news. Ohio is not a demonic cesspool like VA or NY.
I am opposed to abortion, in most situations. However, SCOTUS has made it clear with both conservative and liberal majorities that these kinds of laws are unconstitutional. Several times in recent years they have struck down Ohio’s laws on the subject.
I would appreciate it if the folks we elected in Columbus would recognize that this is not a State issue just as they recognize that gun laws in Ohio are not a city issue. SCOTUS has clearly preempted you just as you have preempted the cities.

This bills serves nothing other than trying to overturn Roe v. Wade. So thank you, Ohio lawmakers. Thank you for attempting to restrict the rights of women across the country and in Ohio. Thank you for using the name of our state and dragging it through the mud for the upcoming Supreme Court battle. Thank you for reassuring me that the state that I love wants to transport back into the 1950’s. Now I feel even more motivated to vote and make my voice heard. And rest assured that I will tell my friends to vote to make sure that the people who voted yes on this bill don’t make it back into government after next election.
